By accessing or using NovaScribe ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
NovaScribe is operated by Proctor Medical Consulting, LLC ("we," "us," or "our"). The Service is available through our website at novascribe.us and through our iOS mobile application.
NovaScribe is an AI-powered medical documentation tool for licensed healthcare providers. The Service records patient encounter dictations, transcribes audio using AI, and generates clinical notes, billing code suggestions, and related documentation.
The Service is intended for licensed healthcare professionals. By using NovaScribe, you represent that you are a licensed healthcare provider or are authorized by a licensed provider to use the Service for medical documentation purposes.
You must be at least 18 years old to create an account.
To use NovaScribe, you must create an account with a valid email address and password. You are responsible for:
One account is intended for use by one individual. Sharing credentials with others violates these Terms and may result in account suspension.
NovaScribe offers subscription plans billed on a monthly or annual basis. Current plan details and pricing are available at novascribe.us/pricing.
All payments are processed by Stripe, our third-party payment processor. By subscribing, you authorize Stripe to charge your designated payment method on a recurring basis.
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You will be charged the then-current subscription rate at renewal.
You may cancel your subscription at any time through your account settings at novascribe.us/settings. Upon cancellation:
Subscription fees are generally non-refundable. If you believe you were charged in error, contact support@novascribe.us within 30 days of the charge, and we will review your case.
Subscriptions are managed exclusively through our website (novascribe.us). The iOS app provides access to your existing account and subscription but does not offer in-app purchases or subscription management.
You agree not to:
We reserve the right to suspend or terminate accounts that violate these Terms.
You retain ownership of all audio recordings, clinical notes, and other content you create using the Service ("Your Content"). By using the Service, you grant us a limited license to process Your Content solely for the purpose of providing the Service to you.
We do not use Your Content to train AI models, sell to third parties, or use for any purpose other than delivering the Service. See our Privacy Policy for complete details on data handling.
NovaScribe processes Protected Health Information (PHI) as a Business Associate under HIPAA. We will execute a Business Associate Agreement (BAA) with your practice upon request.
You are responsible for ensuring that your use of NovaScribe complies with HIPAA and any other applicable healthcare regulations. To request a BAA, contact hipaa@novascribe.us.
Clinical notes, billing codes, and other content generated by NovaScribe are AI-generated suggestions only. As a healthcare provider, you are solely responsible for:
NovaScribe does not guarantee the accuracy, completeness, or appropriateness of AI-generated content for any specific clinical scenario.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
You agree to indemnify and hold harmless Proctor Medical Consulting, LLC, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
You may delete your account at any time through Settings > Privacy > Delete My Account, or by emailing privacy@novascribe.us. Upon account deletion, all your data is permanently removed within 30 days, subject to our data retention obligations described in the Privacy Policy.
We may suspend or terminate your account if you violate these Terms, with notice where practicable.
We may update these Terms from time to time. When we make material changes, we will notify you by email and/or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Alabama, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Jefferson County, Alabama.
